You agree to use the information responsibly, understanding that we strive for reliability but cannot guarantee absolute accuracy. We aim to maintain uninterrupted service availability and distance ourselves from liability for any associated interruptions or defects. CITYPICKS does not control third-party website content but encourages compliance with applicable laws when using our services. We reserve the right to enhance or modify our terms and appreciate your continued support in making CITYPICKSs a valuable resource.
By using the Services, you confirm that you have read, understood, and agreed to be bound by the following Terms, as amended from time to time, and that you will comply with the requirements listed here. If you do not agree with these Terms, please refrain from using CITYPICKS services.

1. Introduction

1.1. Parties: The terms "CITYPICKS," "we," "us," or "our" refer to CITYPICKS, the platform providing a marketplace for various services. "You" or "your" refers to the user accessing or using our platform.

1.2. Services: CITYPICKS provides a platform to connect users with service providers ("Ninjas") offering a range of services, including but not limited to spa nad salon services,home maintenance, cleaning, repairs, security, and other professional services.

2. User Accounts

2.1. Registration

2.1.1. Account Creation: To access CITYPICKS' services, users must create an account by providing accurate and up-to-date information, including full name, email address, contact number, and any other information required during registration. Users warrant that the information provided is accurate and complete.

2.1.2. Age Requirement: Users must be at least 18 years old or the legal age of majority in their jurisdiction to create an account. By creating an account, users confirm that they meet this age requirement.

2.1.3. Account Credentials: Users are responsible for creating secure login credentials (username and password) for their accounts. CITYPICKS recommends using a strong, unique password and not sharing account credentials with others.

2.2. Account Security

2.2.1. User Responsibility: Users are solely responsible for maintaining the confidentiality of their account information and restricting access to their account. CITYPICKS shall not be held liable for any unauthorized access or use of user accounts due to the user's negligence.

2.2.2. Unauthorized Access: Users agree to promptly notify CITYPICKS of any unauthorized access, use, or security breach related to their account. CITYPICKS reserves the right to take appropriate measures to secure the account, including but not limited to password resets or temporary suspension of account access.

2.3. Account Termination

2.3.1.Termination by User: Users can deactivate or delete their account at any time by following the designated account closure procedures on the CITYPICKS platform. Deactivation or deletion of the account may result in the loss of access to certain features and content.

2.3.2.Termination by CITYPICKS: CITYPICKS reserves the right to suspend, terminate, or restrict access to user accounts if there is a violation of these Terms, suspected fraudulent activities, or any unauthorized use of the platform.

2.3.3.Data Retention: Upon account termination, CITYPICKS may retain certain information as required by law or for legitimate business purposes, including but not limited to transaction records, compliance with legal obligations, and resolving disputes.

2.4. Account Usage

2.4.1. Non-Transferability: User accounts on CITYPICKS are non-transferable, and users agree not to transfer or share their account credentials with others. Users are solely responsible for any activity occurring under their account.

2.4.2. Accurate Information: Users agree to keep their account information accurate and up-to-date. This includes contact information, billing details, and any other information necessary for providing and receiving services through CITYPICKS.

2.4.3. Prohibited Actions: Users must not engage in any actions that could harm the security or integrity of the CITYPICKS platform, including attempting to gain unauthorised access to accounts, interfering with system integrity, or violating security measures.

3. Booking Services

3.1. Service Requests

3.1.1. Service Selection: Users have the option to explore a wide array of services available on the CITYPICKS platform, categorised under different service types, such as home maintenance, cleaning, repairs, spa and salon services, marriage photography and decorations, security and various professional services. The platform provides detailed descriptions of each service, including the scope of work, estimated duration, and any specific requirements or add-ons available. Users are responsible for selecting the desired service, specifying details such as service date, time, location, and any specific requirements or preferences.

3.1.2. Service Details: Upon selecting a particular service, users are prompted to specify various service-related details. This includes choosing the preferred date and time for service delivery, specifying the service location (such as a residential address or a specified venue), and providing any additional preferences or instructions essential for the service provider to fulfill the requested service accurately.

3.1.3. Availability Confirmation: After submission of the service request, CITYPICKS initiates the process of finding an available and suitable service provider ("Ninja") based on the user's requested service details. While CITYPICKS aims to promptly match users with available Ninjas, confirmation of service availability is contingent upon the Ninjas' schedules and availability within the requested time frame. We acknowledge the service request upon submission but do not guarantee immediate availability. Ninja' schedules may vary, and the confirmation of service availability is subject to Ninjas' availability.

3.1.4. Matching with Ninjas: CITYPICKS endeavours to match the user's service request with a qualified Ninja based on various factors, including but not limited to the Ninja's expertise, geographical proximity to the service location, and availability. However, users are informed that while every effort is made to ensure timely matching, the confirmation of a suitable professional is supposed to but not necessarily guaranteed at the time of the initial request submission.

3.2. Booking Confirmation

3.2.1. Confirmation Notification: Upon successful matching with an available Ninja or professional, CITYPICKS sends users a detailed confirmation notification. This notification includes pertinent information such as the confirmed service date and time, the identity and contact details of the assigned Ninja, and any other relevant service-related information such as the confirmed service date, time, and the assigned Ninja's information.

3.2.2. User's Obligation: After receiving the booking confirmation, users are expected to promptly review the provided details and confirm their acceptance of the scheduled service by adhering to the stipulated deadlines or the specified time frame. Confirmation by users indicates their commitment to the scheduled service, and CITYPICKS expects users to honor their booking accordingly.

3.2.3. Modification or Cancellation: In instances where users need to modify or cancel the booking details, CITYPICKS may allow reasonable flexibility within a specified timeframe before the scheduled service. Users may have the option, within a reasonable time frame, to modify or cancel the booking details before a certain cutoff time. However, CITYPICKS reserves the right to impose practical limitations or restrictions on modification or cancellation requests to ensure fairness to both users and Ninjas. 3.2.4. Communication with Ninja: Upon confirmation of the service booking, CITYPICKS may facilitate communication between the user and the assigned Ninja. This communication channel allows users to discuss specific service requirements, clarify any details related to the scheduled service, or address queries before the service delivery date.

3.2.5. Service Completion Expectation: After the completion of the service by the assigned Ninja, users are expected to confirm the satisfactory completion of the service on the CITYPICKS platform. This includes providing feedback, ratings, or reviews based on the quality of service received. CITYPICKS encourages users to provide honest and constructive feedback to help maintain service quality standards.

4. Payments, Cancellations, and Refunds

4.1 Payments

4.1.1. Service Charges: Users agree to pay for services rendered by Ninjas based on the rates displayed on the CITYPICKS platform at the time of booking. The pricing structure is transparent and detailed, encompassing the service fees, applicable taxes, and any additional costs associated with specific service requirements or add-ons. CITYPICKS reserves the right to adjust service prices periodically, and users will be informed of any price changes before confirming their bookings.

4.1.2. Payment Methods:CITYPICKS supports various payment methods to facilitate seamless transactions for service payments. Users have the option to use credit/debit cards, online payment gateways, or other designated payment methods available on the platform. By initiating a service booking, users authorize CITYPICKS to charge the provided payment method for the agreed-upon service fees.

4.1.3. Payment Authorization and Processing: Upon completion of the service, CITYPICKS initiates the payment process. The authorized payment method is charged for the total amount due, which includes the agreed-upon service fees, taxes, and any additional charges communicated before the service delivery. CITYPICKS processes payments in a secure and encrypted environment, ensuring the confidentiality and security of users' payment information.

4.1.4. Payment Disputes or Errors: In the event of any payment discrepancies, errors, or disputes, users are encouraged to contact CITYPICKS' customer support promptly. CITYPICKS will investigate reported payment issues in a timely manner and work towards resolving disputes or rectifying errors, if any, to ensure fair and accurate billing.

4.1.5. Failed Payments: In cases where a payment transaction fails or encounters issues due to technical glitches or insufficient funds, CITYPICKS may attempt to notify users regarding the failed payment. Users are responsible for ensuring the availability of sufficient funds or resolving any issues causing payment failures to avoid service disruptions or cancellation.

4.1.6. Payment Security: CITYPICKS priorities the security and integrity of user payments. The platform employs industry-standard security measures and encryption protocols to safeguard users' payment information. However, users are encouraged to take necessary precautions and use secure payment methods to minimize risks related to online transactions.

4.2. Cancellations and Refunds

4.2.1. Cancellation Policy: CITYPICKS implements a comprehensive cancellation policy outlining the terms and conditions governing the cancellation of service bookings. Users are encouraged to familiarise themselves with the cancellation policy associated with the specific service they intend to book. The cancellation policy specifies crucial aspects such as the cancellation window, applicable cancellation fees, and any restrictions or penalties associated with canceling a confirmed booking.

4.2 .2. Cancellation by User:Users have the option to cancel their booked services through the CITYPICKS platform within the defined cancellation window specified in the cancellation policy. Depending on the timing of the cancellation in relation to the scheduled service, users may be subject to varying cancellation fees or penalties as per the policy. CITYPICKS reserves the right to enforce reasonable cancellation fees to compensate for Pros' time and schedule disruptions caused by late cancellations. 4.2.3. Refunds Eligibility and Timelines: Refund eligibility for cancelled services is determined in accordance with the cancellation policy. Upon cancellation, users may be entitled to a partial or full refund, if applicable, based on the terms outlined in the policy. CITYPICKS processes refunds to the original payment method used for the booking within the stipulated refund timelines as specified in the policy. Users are advised that refund processing times may vary depending on payment methods and financial institutions. 4.2.4 Exceptional Circumstances In certain exceptional circumstances, such as unforeseen emergencies, unavoidable circumstances, or instances where the Pro is unable to fulfill the service, CITYPICKS reserves the right to waive or modify the cancellation fees or refund policy on a case-by-case basis. Users are encouraged to contact CITYPICKS' customer support to discuss exceptional cases requiring special consideration for cancellations or refunds. 4.2.5 Communication and Notification Upon initiating a cancellation request, users are encouraged to communicate promptly through the CITYPICKS platform or contact customer support to notify about the cancellation and understand the applicable cancellation fees or refund processes. CITYPICKS will endeavor to communicate any updates or changes related to the cancellation and refund process, ensuring transparency and clear communication with users throughout the procedure.

4.2.6. Dispute Resolution for Refunds In cases where users dispute the refund eligibility or the amount refunded for a canceled service, CITYPICKS will investigate and attempt to resolve the dispute in a fair and timely manner. CITYPICKS' customer support team will review the details of the cancellation, the applicable policy, and any communication related to the cancellation and refund process to arrive at a resolution that aligns with the established terms and conditions.

5. Provisions for "Ninjas"

5.1. Ninjas' Obligations

5.1.1 Service Provision Standards
Ninjas engaging with CITYPICKS agree to uphold high service standards and professionalism. They commit to delivering services in accordance with industry best practices, complying with legal requirements, and adhering to CITYPICKS' service guidelines. This includes providing accurate information about their expertise, certifications, licenses, and relevant experience on their profiles.

5.1.2. Service Quality and Timelines: Ninjas are responsible for delivering services in a timely manner as agreed upon with the users. They are expected to ensure the quality, accuracy, and completeness of the services provided, striving to meet or exceed the expectations outlined by users during the booking process. Punctuality, effective communication, and the use of appropriate tools and resources are essential elements for delivering satisfactory services.

5.1.3. Professional Conduct: Maintaining a professional demeanor is imperative for Ninjas. They must conduct themselves in a respectful and courteous manner during interactions with users. This entails refraining from any behavior that might be perceived as offensive, discriminatory, or unprofessional. Upholding high ethical standards contributes significantly to a positive user experience

5.1.4. Responsiveness and Communication: Ninjas are encouraged to be responsive and maintain open lines of communication with users. Timely responses to inquiries, addressing user concerns promptly, and offering clear communication regarding service-related details contribute to fostering a trusting relationship between Ninjas and users. Effective communication is key to ensuring a smooth and satisfactory service experience.

5.2. Background Checks

5.2.1. Screening Process: Before being listed on CITYPICKS' platform, our professional or Ninjas undergo a stringent screening process encompassing identity verification through official documents, validation of professional credentials, reviews of work history and references, potential criminal background checks, and ongoing monitoring. This multifaceted process aims to verify qualifications, reliability, and professionalism. However, while CITYPICKS strives for comprehensive checks, limitations exist due to information availability and external factors, and absolute accuracy cannot be guaranteed. Users should exercise judgment despite the screening process to ensure the selection of Ninjas or professionals aligns with their needs and preferences, understanding that the process doesn't eliminate all potential risks associated with service providers on the platform.

5.2.2. User-Driven Selection: Users are encouraged to leverage the information available on Ninjas' profiles, including ratings and feedback from previous engagements. CITYPICKS provides users with tools and resources to make informed decisions when selecting Ninjas. Users can use this information to evaluate Ninjas based on their qualifications and past performance.

5.3. Insurance and Licensing

5.3.1. Professional Licensing: Ninjas are obligated to maintain valid professional licenses, certifications, or any other legal permissions required in their respective fields or jurisdictions. These credentials validate their qualifications and expertise, ensuring they are legally permitted to offer their services.

5.3.2. Insurance Coverage: While CITYPICKS may encourage Ninjas to obtain appropriate liability insurance coverage, CITYPICKS does not independently verify or guarantee the insurance coverage of Ninjas. It is the responsibility of users to directly inquire with Ninja regarding their insurance coverage and any limitations or exclusions that may apply.

5.3.3. User Awareness: Users should be aware of and acknowledge any limitations or exclusions related to the insurance coverage provided by Ninjas. CITYPICKS does not assume liability for any lack of insurance coverage or the implications thereof related to the services provided by Ninjas.

5.4. Service Agreements and Disputes

5.4.1. Service Agreements: Service agreements between users and Pros are entirely the responsibility of the involved parties. CITYPICKS does not interfere with or mediate in the contractual agreements or obligations between users and Pros. Users and Pros should have open and clear discussions to mutually agree upon the terms, scope, pricing, and any additional requirements related to the services.

5.4.2. Dispute Resolution: In the event of disputes or disagreements between users and Pros, CITYPICKS may act as a mediator to facilitate communication and aid in resolving disputes amicably. However, CITYPICKS does not assume responsibility for resolving disputes, contractual disagreements, or liabilities between users and Pros. It is incumbent upon users and Pros to attempt to resolve disputes directly between themselves.

5.4.3. Indemnification: Pros agree to indemnify and hold CITYPICKS harmless from any claims, damages, liabilities, losses, or expenses arising from their services. This includes claims related to service quality, breaches of agreement, or disputes between Pros and users. Pros are solely responsible for their actions, conduct, and service provision

6. User Conduct

6.1. Responsible Use of Services: Users engaging with CITYPICKS' platform are expected to utilize the services responsibly, ethically, and in compliance with the platform's terms and conditions. This entails adhering to all applicable laws, regulations, and guidelines governing the use of the services offered. Users are responsible for ensuring that their actions, communications, and engagements with Pros or other users on the platform are lawful and do not infringe upon the rights of others.

6.2. Accurate Information: Users are obligated to provide accurate, complete, and up-to-date information when using CITYPICKS' services. This includes details related to service requests, contact information, and any other data necessary for effective service delivery. Providing false, misleading, or inaccurate information may lead to disruptions in service delivery and could result in account suspension or termination.

6.3. Respectful Communication: Maintaining respectful and courteous communication is fundamental. Users are encouraged to engage with Pros, CITYPICKS' support team, and other users in a respectful manner, refraining from engaging in any form of harassment, discrimination, or abusive behavior. Respectful communication fosters a positive environment for all users and Pros on the platform.

6.4. Compliance with Policies: Users must comply with all policies, guidelines, and procedures outlined by CITYPICKS. This includes but is not limited to the acceptable use policy, privacy policy, and community guidelines. Familiarizing themselves with these policies ensures users' compliance with platform rules and standards, contributing to a safe and conducive environment for all users.

6.5. Prohibited Activities: Engaging in any form of prohibited activities, including but not limited to fraudulent behavior, unauthorized access to the platform, attempting to interfere with the platform's functionality, or circumventing security measures, is strictly prohibited. Users are prohibited from engaging in activities that could compromise the integrity, security, or stability of CITYPICKS' platform or the services offered.

6.6. Content Guidelines: Users engaging with CITYPICKS are expected to adhere to specific content guidelines. This includes refraining from posting or sharing content that is false, misleading, abusive, discriminatory, or infringes upon the rights of others. Users must avoid content promoting illegal activities, explicit or offensive material, or content violating intellectual property rights. CITYPICKS reserves the right to remove or restrict access to any content that breaches these guidelines, ensuring a safe and respectful environment for all users and Pros on the platform.

6.7. Consequences of Misconduct: Violation of these user conduct guidelines or CITYPICKS' terms and conditions may result in various consequences, including but not limited to account suspension, termination, or legal actions if the violation breaches applicable laws or regulations. CITYPICKS reserves the right to take appropriate actions to address user misconduct, ensuring the platform's integrity and the well-being of its users and Pros.

7. Intellectual Property Rights

7.1. Respect for Intellectual Property: Users engaging with CITYPICKS' platform must respect the intellectual property rights of CITYPICKS, Pros, other users, and third parties. This includes copyrights, trademarks, patents, trade secrets, and any proprietary information protected by intellectual property laws. Users are prohibited from using, reproducing, modifying, distributing, or publicly displaying any intellectual property without proper authorization or licensing.

7.2. Ownership and Usage Rights: All content, including but not limited to text, images, graphics, logos, software, and any other materials displayed or made available on CITYPICKS' platform, is the intellectual property of CITYPICKS or its licensors. Users are granted limited, non-exclusive, and revocable permission to access and use the platform for personal or non-commercial purposes. Any use beyond the specified permissions requires explicit consent or licensing from the respective rights holders.

7.3. User-Generated Content: When users contribute content, such as reviews, feedback, or submissions, to CITYPICKS' platform, they grant CITYPICKS a worldwide, royalty-free, perpetual, and irrevocable license to use, modify, adapt, reproduce, and distribute such content. This license allows CITYPICKS to display, promote, or improve its services and platform. Users retain ownership of their content but grant CITYPICKS the necessary rights to facilitate platform operations.

7.4. Reporting Intellectual Property Violations: Users or rights holders who believe that their intellectual property rights have been infringed upon by content displayed on CITYPICKS' platform can submit a notification to CITYPICKS' designated agent. The notification must include details of the alleged infringement, including the copyrighted work, trademark, or other rights allegedly violated. CITYPICKS will review the notification and take appropriate action, such as removing the infringing content if found valid.

7.5. Disclaimer of Responsibility: 
CITYPICKS does not actively monitor all content uploaded or shared on the platform but endeavors to promptly address reported intellectual property violations. While CITYPICKS strives to maintain a platform free of intellectual property infringements, it does not guarantee the accuracy, completeness, or authenticity of user-generated content. Users are encouraged to report any potential infringements, and CITYPICKS will take reasonable steps to investigate and resolve reported violations.

7.6. Indemnification: Users agree to indemnify and hold CITYPICKS harmless from and against any claims, damages, liabilities, losses, or expenses arising from alleged intellectual property violations related to the content they upload, share, or submit on the platform. Users are solely responsible for ensuring that their contributed content does not infringe upon the intellectual property rights of others.

8.1. External Links and References: CITYPICKS' platform may contain links, references, or connections to third-party websites, services, or resources for users' convenience or information. These third-party links are provided solely for users' convenience, and CITYPICKS does not endorse, control, or have any responsibility for the content, privacy practices, or functionalities of these external websites or resources.

8.2. User Discretion and Risks: Users acknowledge and agree that their use of third-party links is at their own discretion and risk. CITYPICKS recommends that users review the terms of use, privacy policies, and any other relevant documents governing these third-party websites or resources before engaging with them. Users should exercise caution and understand that CITYPICKS does not guarantee the accuracy, reliability, or legality of content or services offered by third-party links.

8.3. Limitation of Liability: CITYPICKS provides the platform "as is," and we do not guarantee the accuracy, reliability, or availability of services. We do not warrant that the platform will be error-free, secure, or uninterrupted. CITYPICKS or its affiliates do not assume responsibility or liability for any damages, losses, or issues arising from users' interactions, transactions, or engagements with third-party websites or resources linked from CITYPICKS' platform. Users acknowledge that CITYPICKS shall not be held accountable for any content, products, services, or actions of third-party websites accessed through the provided links.

If the dispute cannot be resolved through negotiation within a reasonable time frame, both parties agree to submit the dispute to mediation or arbitration. Mediation involves engaging a neutral mediator to assist in reaching a resolution. Arbitration involves the referral of the dispute to an independent arbitrator or arbitral tribunal for a binding decision.

Legal Proceedings: If mediation or arbitration does not lead to a resolution, and legal action is necessary, users agree that any legal proceedings arising from disputes shall be brought exclusively in the courts of the jurisdiction where CITYPICKS operates or is legally established. Users consent to the jurisdiction and venue of these courts for resolving disputes related to CITYPICKS' terms and conditions.

9.4. Language of Disputes: In case of any discrepancies or differences in the interpretation of translated versions of CITYPICKS' terms and conditions, the English language version shall prevail and be used for legal and dispute resolution purposes.

10. Changes to Terms

Changes may include amendments to service offerings, features, functionalities, or any other aspects deemed necessary for enhancing the platform's operation, compliance with legal requirements, or improvement of user experience. CITYPICKS may notify users of changes to the terms and conditions through various means, such as email notifications, website announcements, or in-app notifications. Notifications may include summaries of modifications or direct links to the updated terms for users' review.
